Luvsanvandan Bold MP: principal revolution in Human rights

MPs, including D.Ganbat, Chairman of Standing Committee on Law, L.Bold, Ts.Oyungerel, Kh.Temuujin, D.Dorligjav, Minister of Legal Affairs,  addressed today to the media on number of issues. Last Friday they had reported on ratification of a significant law.

25 years ago on this Mongolia had ratified the Constitution. And the law ratified last Friday perhaps should be listed after the Constitution which is the Criminal procedure law and Law on Law Enforcement Actions. MPs provided an information about the laws and highlighted that the new laws shall be enforced from September 1, 2016. We have interviewed head of the Working Group, MP Luvsanvandan Bold.

- Amendments are made to the vital laws such as law enforcement, criminal code by the Parliament. What are the most critical attributes as lawyers say that vital amendments are made which brings legislation reform?

- For any parliament is the main objective is to pass a significant law, make legal reform. For this Parliament (2012-2016) we have successfully ratified legislation package including Criminal code, Law on Violation, Criminal procedure and Law enforcement. This is very significant revolution for human rights issue. These changes and amendments shall bring substantial changes like privatization, political and economic modernization.

Only member of the Mongolian parliament was protected with old legal system, and now the legal reform every citizen of Mongolia is under the legal protection.  On the other hand, significant changes were made to the legislation to ensure legal actions and actions to protect human rights within scope of the Constitution.

It means that at least we have completely stopped illegal actions where people were arrested for uncertain period, opening and closing crime cases whenever wanted. Cases happen to turned into deeds used for political or personal purpose, becomes tool of trading. The old structure which was violating rights of citizens through repression, abusing is completely replaced with new system which is the significant achievement for Mongolia.

- 20 years has been passed since Mongolia claimed to be a democratic country respecting human rights. But as you said we haven’t made significant changes to actually respect human rights?

- What we have done is the reform which Mongolia couldn’t achieve in the past 100 years. The old legal authorities called an abusive tool, investigating and questioning everyone associated with crime and guessing the crime will be revealed somehow and now we are changing this senseless and fearful structure. Besides the legal authorities were never recognized human as a human.

And now we have amended the legal system first time ever reaching paradigms of world’s democratic countries. By doing this the crime investigation and detection shall actually improve. And the crime will be detected. No one will suffer from repression.

With the new Criminal code, punishments of many shall be not be considered as an actual crime. This means that the law shall work for humans and punishment shall be imposed to people who committed. And this new structure to be enforced in Mongolia which is the significant achievement for Mongolia.
