Constitutional court recommendation to be discussed tomorrow

Middle seat session of the Constitutional Court (Tsets) resolved that the provision to elect not more than 28 members of the Parliament through the ratio list breaches the provisions of Chapter 21, part 2 and 3 of the Constitution. The decision creates a complicated condition to change the synthesis of proportionate and majority systems entered during the 2012 elections. The resolution of the Constitutional Court was provided by the DP and MPP caucuses in the Parliament. With such support, candidates have high expectation that, 76 members to be elected from the constituencies. The Integrity caucus of MPRP and MNDP at the Parliament protested the decision; the support of two main political forces is very much likely means ratification of the resolution by the Parliament. In May of 2012 the Constitutional Court had once ratified the decision to organize the elections in synthesis system consisting of proportionate and majority systems.

The recommendation of the Constitutional Court was discussed during the Legislation Standing Committee session with 64.2% support of attended quorum and was submitted to the plenary session today. Although Z.Bayanselenge, MP, deputy head of Integrity caucus requested 5 day timeout, due to upcoming elections, she was given only half day break which means that the recommendation of the Constitutional Court shall be discussed during tomorrow’s session of the Parliament.

Public raised concerns and criticize the “list” members as parties get 28 seats per party listing against 48 elected from constituencies. Meanwhile if the Parliament shall accept the decision of the Constitutional Court, all 76 members of the Parliament shall be elected from the constituencies and 20 seats of the party listing shall be allocated in local areas and eight for UB city. Such proposal was raised by the MPP, although there is another version to directly elect members from undersized constituencies.

The support of two main political parties could be seen as anxiety due to their regressing reputation. And word of mouth says that both parties are trying hard to benefit from their advantages: MPP in the countryside and DP in UB. MPRP lead by ex-President of Mongolia N.Enkhbayar said to have objections against the decision as they expect to add their seats in the Parliament through getting supports of voters for more than 5%. Seats of parties per party listings in 2012: DP-10, MPP-9, MPRP and MNDP coalition - 7, CWGP - 2. Along with such expectations the recently activated National Labor Party hopes to get 5% votes to pass the party listing criteria. 

The recommendation is strongly criticized by some MP and small parties, but it’s more likely that the Parliament shall ratify the recommendation of the Constitutional Court tomorrow.
